Professional Negligence Claims
Professional negligence is a subset of the general rules on negligence, to cover the situation in which the defendant has represented him or herself as having more than average skills and abilities. The usual rules rely on establishing that a duty of care is owed by the defendant to the claimant, and that the defendant is in breach of that duty.
At Aquila we will investigate the nature of the claim, benchmark against expected levels of care and assess any losses caused. Our reports will be a comprehensive review of the facts and assessment of any shortcomings or defences.
As no two parties will approach their duty of care in exactly the same way it is necessary when evaluating a person’s conduct and whether they have met the necessary standards to be able to make a subjective assessment as well as an objective assessment of the facts.
